In a bid to stop a purported planned arrested and taken to Abuja over recent violent political activities in the state, the chairman of Esan North East local government area, Hon Dr. Kelly Inedegbor has obtained an interim injunction stopping the Inspector General of Police and his agents from arresting him pending the determination of the substantive in a suit before the court.
In the suit marked B/229M/2024 between Inedegbor as applicant and the Inspector General of Police as the respondent before the vacation judge, Justice Igho Braimoh, the chairman in the enrolment order an interim Order of Court to restrain the respondent from arresting and detaining or take any action that would infringe on his right to personal liberty “pending the hearing and determination of substantive application in this suit.”
The case came for hearing on Thursday and the application was brought before the judge by Carrington Omokaro Esq. of the Olayiwola Afolabi (SAN) & Co.
In his ruling, the judge granted the prayers sought by the applicant saying “The Court having heard Carrington Omokaro, for the Applicant, order as follows.
“I hereby restrain, the Respondent, whether by himself, or through his agent(s), aide(s), surrogate(s), appointee(s), delegate(s), officer(s), or any other person, from arresting, and detaining the Applicant; or in any way, or manner infringing on the Applicant’s right, to personal liberty, pending the hearing and determination of the substantive application in this suit.
“This Interim injunction abates after 14 days. The Respondent, Inspector General of Police should be put on Notice. He adjourned the case to the 26th day of September, 2024.”
